Change to Penal Code section 4019: ADI’s guidance on helping clients get the advantage of additional pre-sentence conduct credits provided in SBx3 18 is here. Although People v. Rodriguez (March 1, 2010, F057533) ___ Cal.App.4th ___ held the statutory amendment was not intended to apply retroactively, that case is not yet final. Other cases are pending. ADI’s guidance remains the same. In abbreviated form: Contact trial counsel. If he or she is not going to be acting, the first step usually should be to file a Pen. Code, § 1237.1 motion in the trial court. Sample attached to February 2 alert. If that is unsuccessful, raise the issue on appeal.
