Change to Penal Code section 4019: ADI’s guidance on helping clients get additional pre-sentence conduct credits under the recent amendment to PC § 4019 is in the February 2 and 26, 2010, news alerts here.
The Supreme Court has granted review in People v. Brown, S181963, to decide the retroactivity of the amendment. Counsel should continue to raise the issue: Contact trial counsel. If he or she is not going to be acting, file a PC § 1237.1 motion in the trial court. A sample is with Feb. 2 alert, but should be updated to note the grant of review in Brown and published Court of Appeal cases, as listed here. If that is unsuccessful, raise the issue on appeal. If that is unsuccessful, petition for review.
