2005 RULE CHANGES

November, 2005 - New Criminal Jury Instructions

The Judicial Council adopted the new CALCRIM instructions on August 26, 2005 to be effective January 1, 2006. The time period between August 26, 2005 and January 1, 2006, is a transition period deliberately conceived to provide a chance for litigants to ease into the new instructions. Rule 855 of the California Rules of Court implicitly provides the trial court with discretion as to which instructions to use during this period.

July, 2005 - New and Amended Rules & Updated Judicial Council Forms

The Judicial Council has published another installment of the revisions to the California Rules of Court. While not as extensive as the major changes made in January of 2005 (see below), the current set of new and amended rules affects the appellate practitioner. Additionally, the Judicial Council published updated Judicial Council forms. Among the updated forms is a new Petition for Writ of Habeas Corpus form that can now be completed on-line. The new rules and forms were effective July 1.

Charts and Highlights of Rules Changes Effective January 1, 2005

The Judicial Council has approved the last installment of the revisions to the California Rules of Court, and they went into effect on January 1. In the revision process, all of the rules have been rewritten for clarity and simplicity, with a view to making each set of rules (civil, criminal, juvenile, etc.) self-contained. Many of the sections have been reorganized and/or renumbered, and in a number of cases substantive changes have been made.

The most recent installment is fairly extensive and deals with seven different areas of appellate law. We have prepared a memo for each of the seven affected areas of appellate law summarizing the major changes. Along with each memo, there is a corresponding chart. The charts show the topic, new rule number, old number, and comments about significant provisions.
