Filing Rules Summary


Calculation of Due Dates

If the date for doing an act falls on a day the court is closed, it is timely if done on next business day. (Code Civ. Proc., §§ 10, 12a, 12b, 135; rule 1.10.) Under Code of Civil Procedure section 12, on computation of time: “The time in which any act provided by law is to be done is computed by excluding the first day, and including the last, unless the last day is a holiday, and then it is also excluded.” For emergency orders affecting due dates, see rule 8.66 and the court website.

Filing and Service

Electronic documents are “filed” when received by court clerk’s office. (See Cal. Rules of Court, rule 8.25(b)(1).)
